Army Veteran Fights HOA for Right to Fly the Flag

HOA flag disputeA 77-year-old Army veteran in Macedonia, Ohio, is fighting for the right to raise the American flag in his front yard.

Fred Quigley, a retired Army chaplain and minister who served active duty during the Vietnam War, is being threatened with legal action because his flag violates his homeowners association's rules on flagpoles. As an alternative, the HOA offered to place the flag at the entrance of the development.

Quigley (pictured above at his home) refused.

"It's the principal," Quigley told AOL Real Estate during a phone interview. "It's about patriotism, and the soldiers I've had to hold as they were dying. It's just important to me to be bold with the flag."

And according to Quigley's attorney, Gerald Patronite, the HOA has no right to stop his client. Patronite cites a 2003 state statute that addresses the homeowner's rights in such a dispute. "Essentially, no deed restriction or association can abridge this right to display the flag," he told AOL Real Estate.

Patronite said that the HOA's rules state that a flag can only be displayed if affixed to the home. But doing so, he said, would force Quigley to hoist a much smaller flag.

flag dispute hoaQuigley's daughter, Karen Wilson, said that she doesn't understand how anyone could deny her father the right to raise the flag.

"It's a standard 15-foot pole, a 3-by-5 flag," Wilson said. "It's not outlandish, it's not over-the-top, and it fits in with the house."

Joseph Migliorini, the representative for the homeowner's association and former mayor of Macedonia, which is between Cleveland and Akron, did not return our calls. He did, however, tell a local news affiliate that he plans to take Quigley to court if the flagpole is not removed.

"We just want the rules and regulations followed," Migliorini told NewsNet5. "We're not gonna have rogue homeowners that are going to just do what they want to do and not get approval."

This is not the first time that homeowners have clashed with an HOA over the right to display the flag. In Idaho, the dispute ended in a public apology from a homeowners association that prohibited flags in "common areas." In that case, the "Freedom to Display the American Flag Act" of 2005 was cited to uphold the homeowner's right.

On Wednesday, members of the local American Legion post joined Quigley (pictured left) in a flag-raising ceremony in protest of the association's policy. Quigley said that he's been given until Monday to remove the flag, or further legal action will be taken by the HOA.

"As a minister and a chaplain, I have fought for people," Quigley said. "Now I fight for myself."

House of the Day: Historic Lodge in the Adirondacks

They had me at the fireplaces. There is something about a massive stone fireplace or nine that just gets my heart going pitter-patter. The Camp Kwenogamac lodge on New York's Long Lake -- listed for sale now at $6,495,000 and built in 1903 for the surgeon who literally wrote the textbook on the use of antiseptics -- hosted diplomats, opera singers, and a number of celebrity contemporaries, including Helen Keller and her teacher, Anne Sullivan, and Gene Tunney, the champion prizefighter.

Secluded and surrounded by wilderness, the 42-acre gated estate was completely renovated, beginning in 2000, and is now a green, self-sufficient home. The original historic lodge, now used in summer, has six bedrooms and three fireplaces, along with a historic library.

The new guest lodge, suitable for year-round use, has three bedrooms, each with its own bathroom, a great room with full kitchen, and another three fireplaces.

The piece de resistance may be the year-round-use floating boathouse, with a second story great room that I wouldn't ever want to leave. And yes, another three fireplaces.

The property has 1,233 feet of sandy beach frontage, and a hiking trail loop that's also suitable for snowshoeing or cross-country skiing, and which goes past the original owner's graveyard. There is a 750-foot deep well.

There is also a ton of history here. The property was built for Dr. John Gerster who, in the interests of serving his guests' sophisticated palates, often had fresh lobster delivered from New York City by train and iced at every stop.

Katharine Hepburn's Connecticut 'Paradise' for Sale

Katharine Hepburn was nothing if not passionate, and one of her fiercest attachments was to Fenwick, her estate on the water in Old Saybrook, Conn. From 1939, when the Hepburn family built it, to 2003, when the actress died there at age 96, it was her favorite place of refuge.

And now, according to Realtor.com, it's on the market for $28 million.

The current owner, New York developer Frank Sciame, bought the property in 2004 for $6 million, subdivided the acreage, and completely renovated the house. He told the Wall Street Journal that he planned to flip the place long ago, but his family "fell in love with it" and started spending summers there. (And who could blame them?)

Overlooking the Long Island Sound, the 8,000-square-foot house has six bedrooms, seven-and-a-half baths, a den, a "chart room" and a gourmet kitchen. Colette Harron with William Pitt Sotheby's International has the listing.

Most Expensive, Most Affordable Housing Markets

most affordable housingEver wondered what your home might cost you if you shipped it to Any Town, USA? Depending on where you land, that same house could cost nearly $2.4 million more than what you paid, according to a new housing survey.

This week Coldwell Banker released its second annual Home Listing Report, which looks at the average listing price of four-bedroom, two-bath homes in more than 2,300 markets. And the gap between high and low is striking.

The most affordable market in America, Niagara Falls, N.Y., averaged a listing price of $61,000 while the most expensive, Newport Beach, Calif., commanded a whopping $2.5 million.

This is the second straight year in which Newport Beach has topped the list for the most expensive housing market -- an especially impressive feat considering that the survey included 2,000 more markets this year. In total, six out of the 10 most expensive markets hailed from the aptly named Golden State.

"The super high-end market has really rebounded," said Jim Gillespie, CEO of Coldwell Banker, in an interview with AOL Real Estate. In last year's survey, Newport Beach took the top spot with an average listing price of $1.8 million -- this year it commanded an average $2.5 million.

Some Surprisingly Affordable Suburbs

On the other end of the spectrum, the tiny tourist haven of Niagara Falls, N.Y. came in as the most affordable market in the survey, with an average listing of $61,000. The rest of the 10 most affordable markets include a smattering of the hardest-hit markets in the wake of the housing bust, like suburbs of Florida, Arizona and, of course, the steely city of Detroit.

Surprisingly, though, it was Georgia that made the most appearances on the affordable end of the spectrum, with three cities: Riverdale, College Park and Lithonia -- all of which averaged under $80,000.

"Atlanta has had a very tough market," Gillespie said. Economically, "it's not much worse than some other major cities, but had a lot of new construction that hit at the wrong time."

Despite the widening gap in prices, there are still ample opportunities to buy an affordable -- and rather sizable -- home in America. The report found 24 markets where the average listing price for a four-bedroom, two-bath home was under $100,000. More than 1,500 markets averaged less than $300,000.

Procter & Gamble expands in Minneapolis

CSM completes Lockheed deal in Eagan

CSM Corp. has closed on its purchase of the 51-acre campus of Lockheed Martin in Eagan. The deal had been announced in April. Terms of the sale haven't been released. If you're trying to sell your house, the first thing a Realtor will tell you is to break out the paint roller. A fresh coat of paint is the quickest and least expensive way to lighten, brighten and perk up a home's interior. It's also a job you can tackle yourself--if you do it right. In today's "DIY Diagnosis," our friend Brie Dyas at DIYLife tells you how to paint a room for great results.


The arrival of a new season always triggers a need to change up the wall colors in my home. And when I want a change, I want one now. But when it comes to painting a room, it's easy to get swept up in getting the job done instead of getting the job done right. Here's a handy list of common problems that can come up, why they did and how you can stop 'em.

- A dark hue looks faded. This happens when you paint over a light color with darker one. To prevent this from happening, apply a gray-tinted primer coat in between. This will stop the lighter hue from bleeding through the bolder one, and will create a neutral base that'll let bold hues look their best.

- A random shiny spot appears a week after painting. When a flat paint is applied to a high-traffic area, a glossy spot can appear where hands (or a sponge) frequently comes in contact with the painted surface, rubbing off the matte finish. So, when it comes to high-traffic areas where you know you'll have to do some cleaning, go for a semi-gloss.
